Our Services are provided in collaboration with local carrier networks worldwide. We strive to provide consistent, high-quality connectivity, but you acknowledge that:

• Service availability, network coverage, and cellular transmission speeds are subject to local network conditions, geographic topography, and weather interference.
• Network access may be subject to temporary suspension or capacity throttling during peak congestion windows or carrier maintenance hours.
• We do not guarantee access to specific speed generations (such as 5G or LTE) in all coverage regions. Connectivity quality defaults to the local partner carrier's capabilities.

To ensure premium service quality and network integrity for all travel subscribers, we enforce a strict Fair Use Policy (FUP). While we offer plans with high or unlimited data caps:

If your data consumption habits disproportionately congest local carrier networks or indicate non-standard utilization (such as automated server hosting, commercial file sharing, or continuous high-definition video streaming setups), the local network partner reserves the right to throttle bandwidth or temporarily suspend connection access.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ESIM NET LLC, ITS OFFICERS, OR NETWORK PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities caused by network disconnects.
• Device damage or hardware malfunctions resulting from eSIM configuration.
• Data losses or local transport connection failures while traveling.

Our cumulative liability for any single or aggregated claims arising out of or related to these Terms or the Services shall not exceed the total fee paid by you for the specific eSIM purchase under dispute.

We shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control (a "Force Majeure Event"). This includes telecommunication carrier network strikes, government regulations, natural disasters, national conflicts, acts of God, or global routing outages.

13. Governing Law & Disputes

These Terms, your use of the Services, and all legal relationships between you and ESIM NET LLC shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation or breach, shall be settled through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Delaware, and the proceedings shall be conducted in English.

We reserve the right to suspend or terminate your access to the Site or deactivate your eSIM plans immediately, without notice or liability, if:

• You violate these Terms or our separate policies.
• You engage in fraudulent, illegal, or abusive payment behaviors (such as unauthorized chargebacks).
• We are required to do so by local law enforcement, regulatory bodies, or our telecommunication partners.
